Last Will of Joseph Cary: Be it remembered that on the twenty third day of September one thousand eight hundred and fourteen personally appeared before me Philo Ruggles surrogate of the law County Jereusiah Rozell of Fishkill in Law County who an oath declared that he did see Joseph Cary sign & seal the annexed written instrument reporting to be will of the said Joseph. (but having no date). I heard him publish and declare the same as I for his last will & Testiment that at the time thereof he the saw Joseph Cary was of sounddisposing & mind & memory to the best of the knowledge & belief of him the said Jereusiah & that he the said Jereusiah, Allen Shepard & Jacob Schouton severally subscribed the will as witnesses thereto in the Fetators presence.
Philo Ruggles Surrogate: The people of the State of New York by the grace of God free & Independant: To all to whom these presents shall come or may concern said greeting. Know yee that at Poukeepise in Doutchess County on the twenty third day of September in the year of our lord one thousand eight hunderd and fourteen before Philo Ruggles Esquire Surrogate of our said county the Last Will & Testiment of Joseph Cary deceased a copy whereof is hereinto annexed was proved & is now approved & allowed of by us & the said deceased having whilest he lived & at the time of his death good Chettels, or credit within this state by means whereof the proving & regesteringthe said will & and the granting administration of all & singular the said good chattels & credits & also the auditing, allowing & final discharging the account thereof doth belong unto us: the administration of all singular the said good chattels & credits of the said deceased & any way concerning his will is granted unto Thomas Cary & John Cary, two of the Executors in the said will named they being first duly sworn well I faithfully do administer the same & to make & exibit a true & perfect inventory of all singular.
In the name of God Amen I Joseph Cary of the town of Fishkill, Dutchess County and The State of New York being weak in body but of perfect mind & memory blessed be Almighty God for the same do make & Constitute this my last will and testament in manner as following that is to say first I give my soul to Almighty God that gave it me & my body to be buried in a Christian like manner at the descretion of my Executors whom I appoint my sons Thomas, Jesse, & John. Second I order land to be devided between my two sons Jesse & John that to devide the meadow equal & then across to John N Bailey's line & Jesse to have the south part & to have five rows of apple trees on the east side of the orchard ingrada the term of seven years & John to have the north part. I also give my son Thomas one hundred dollars, likewise my son Matthew one hundred dollars, & my son Isaac one hundred dollars, my sons Joseph, Samuel, William & Nathan I give them each ten dollars. I also give Oliver (?) son Cary (?) five dollars & my movable property to be sold & divided among my daughters equal except one bed & bedding which I give Joanna & Excepting Sarah & I gave her twenty five dollars then the remainder to be devided between Mary, Phebe, Martha, Polly & Susan - the legaises I order my son Jesse to pay one hundred dollars of them & the remainder I order that my son John to pay & John to pay all my lawfull debts & likewise to find & support his sister Joanna in a decent manner - I hereby revoke all other wills by me made. - Joseph Cary
